Mobbing, Case Study on Application of Law in Court Proceedings in Republic of Srpska

Abstract

Mobbing as a legal institute has been recognized by the Law of Republic of Srpska since 2007. Accordingly it
still raises diff erent questions and causes confusion, especially since an another law that treats the same matters, The
Law on Prohibition of Discrimination, has been adopted on the level of BIH state. This paper defi nes and describes what
is mobbing, how it is diff erent from discrimination and explains some articles of the Law. It also provides case studies of
still sparse court proceedings and gives advice on how to easily recognize mobbing in practice and to deal with it in court.
