Whu is the Fingerprint of Anilliterate Person in the Verificaton of Documents Unreliable for Expert Testimony
Abstract
In practice, illiterate persons perform a fingerprint of the right hand instead of a signature in documents where
verification with a personal signature is provided. This is done with the help of persons in the services authorized by law:
in the registry offices of municipalities, courts, police and notaries. The procedure for performing fingerprint authentication is defined by law, but the manner of performance in practice is performed in such a way that the performed fingerprint is of poor quality and is not reliable in the expertise of its authenticity. In practice, finger staining is performed
by pressing the finger / forefinger on the surface of a textile pad soaked in stamp ink and then pressing the paper. Due to
the high surface roughness of the textile cushion, the ink was not evenly adsorbed on the protruding papillary lines and
fingertips, and a fingerprint with dashed papillary lines was obtained, and the minutes were almost invisible.
If a fingerprint is not made with clear papillary lines and if there are at least twelve visible minutions between the papillary lines, then such a fingerprint is of poor quality and unreliable for establishing its authenticity with an indisputable
fingerprint in which papillary lines and present minutions are clearly visible. The rule in the expertise of the authenticity
of the disputed fingerprint is to determine the identity of the structure of papillary lines in the disputed and undisputed
fingerprint by the graphical-comparative method of identity and non-identity, to determine the identity or non-identity
of at least twelve presentations in the disputed and undisputed fingerprint. If the disputed fingerprint in the document is
of poor quality and unprofessional, then such a fingerprint is unusable for any comparison with the undisputed fingerprint of a certain person.
