Establishing the Basis for Material Damages Claims in Casco Insurance on the Example of Insured Case in Traffic

Abstract

An insured case is the future, sudden incident not depending on the will of the insured person, which consequence is the realization of the damaging event, i.e. it is an event which occurrence is the realization of the risk covered with the insurance. With the Casco insurance this means that the future of the contract depends whether the damage on the insured vehicle is full, total or partial. The following dilemma is analysed in this paper: traffic accident or event in traffic in treatment of the location where the damaging event occurred and the influence of the insured person’s will in the occurrence of the event.
